<p align="center"><strong>“BORDER SECURITY, ECONOMIC OPPORTUNITY, AND IMMIGRATION MODERNIZATION ACT” </strong></p>
<p style="text-align: left;" align="center"><strong> </strong>On April 17, 2013, the U.S. Senate introduced proposed immigrant reform in an Immigration Bill: “<strong>Border Security, Economic Opportunity, and Immigration Modernization Act”.  The proposed law included, but are not limited, to the following:</strong></p>
<p>&nbsp;</p>
<p><strong>REGISTERED PROVISION IMMIGRANT (RPI)</strong></p>
<p>A. Registered Provision Immigrant (RPI) status<strong> for undocumented persons in U.S. prior to December 31, 2011:</strong></p>
<p><strong>1. Eligibility<em>: </em></strong></p>
<p>(a)    Continuous physical presence since December 31, 2011- certain exceptions apply such as brief trips after December 31, 2011.</p>
<p>(b)   Derivative spouses and unmarried children also eligible if physically present when principal granted and present on December 30, 2012.</p>
<p>(c)    Can apply for RPI status from outside U.S. if physically present in U.S. prior to December 31, 2011, were deported for non-criminal reason, and have USC or LPR spouse or child.</p>
<p>(d)   Current removal proceedings or reinstatement does not bar eligibility.</p>
<p>(e)    Public charge, labor certification and documentation requirements grounds of inadmissibility do not apply.</p>
<p>(f)    Unlawful entry, stowaways, misrepresentation, and other grounds of inadmissibility do not apply unless inadmissible conduct after statute enacted<em>.</em></p>
<p>(g)    Failure to attend removal proceeding or prior removal grounds of inadmissibility does not apply unless after date of registration.<em> </em></p>
<p><strong>2. Ineligibility<em>: </em></strong></p>
<p>(a)    If convicted of three misdemeanors or one felony, aggravated felony, voted unlawfully, national security, or health-related grounds &#8212; minor traffic offenses excepted AND conviction does not include an expungement.</p>
<p>(b)   If green card status, refugee, valid non-immigrant status – except TPS status.</p>
<p>(c)    Subject to grounds of inadmissibility not specifically exempted, but waivers available non-criminal, non-security related grounds of inadmissibility based on humanitarian concerns, family unity, public interest</p>
<p><strong>3. Advantages<em>: </em></strong></p>
<p>(a)    RPI status allows for protection from deportation, detention, work authorization, travel.</p>
<p>(b)   No accrual of unlawful presence.</p>
<p>(c)    Six years of RPI status and extension</p>
<p><strong>4. Application Process: </strong></p>
<p>(a)    Application period will be for one year after final regulation (possible 18 month extension).</p>
<p>(b)   Pay filing fee, $500 penalty, and accessed taxes.</p>
<p>(c)    Applications may be filed by family unit.</p>
<p>(d)   Filing fee required for those 16 years old and over</p>
<p>(e)    Biometrics and biographic will be conducted.</p>
<p>(f)    Interview</p>
<p><strong>5. Extension: </strong></p>
<p>(a)    RPI status renewable for an additional 6 year period upon payment of filing fee, $500 penalty, remains eligible, and maintenance of regular employment.</p>
<p><strong>6. DACA Recipients’ Provisions: </strong></p>
<p>(a)    DHS may grant RPI status to DACA recipient if national security clearances and law enforcement clearances completed and no conduct since DACA approval that would make person ineligible for RPI.</p>
<p><strong>B. Can apply to adjust to Green Card status after 10 years:</strong></p>
<p><strong>Some of the conditions included, but are not limited to:</strong></p>
<ol>
<li>Clearing of current family-based backlog and other matters.</li>
<li>Demonstrate continuous residence, payment of taxes, regular employment in U.S or poverty guidelines income, knowledge of English and civics, remains eligible for RPI (no denial or revocation).</li>
<li>Payment of filing fee and $1,000 penalty.</li>
<li><strong>After 3 years, may apply for Naturalization after Green Card status.</strong></li>
</ol>
<p>&nbsp;</p>
<p><strong>DREAM ACT &amp; GREEN CARD</strong></p>
<p><strong>DREAM ACT &amp; applying for Green Card status for certain noncitizens who entered the U.S. as children:</strong></p>
<p><strong>1.      </strong><strong>Eligibility:</strong></p>
<p>(a)    RPI for five years.</p>
<p>(b)   Younger than age 16 on date of initial entry to U.S.</p>
<p>(c)    Has high school diploma or GED in U.S.</p>
<p>(d)   Has higher education degree or at least 2 years in good standing toward higher education degree; or has served in uniformed services for at least 4 years and, if discharged, received an honorable discharge. An exemption from this requirement is available based on hardship.</p>
<p>(e)     Listing each secondary school attended in U.S.</p>
<p>(f)    Has knowledge of civics and English; exception for physical or developmental disability.</p>
<p>(g)    Time in RPI status can be considered as Green Card status for naturalization eligibility.</p>
<p>&nbsp;</p>
<p><strong>AGRICULTURAL WORKERS </strong></p>
<p><strong>1.      </strong><strong>Eligibility:</strong></p>
<p>(a)    Farmworkers who have been working in the U.S. for 100 “work days” in the last two years can qualify for Agricultural Card Program.</p>
<p>(b)   They can apply for Green Card status after working in agricultural employment for either three years (at least 150 days/year) or five years (at least 100 days/year), show payment of taxes, no serious criminal conviction, and $400 fine.</p>
<p>(c)    Spouses and children also eligible as dependents.</p>
<p>(d)   This streamlined agricultural guest worker program to replace current H-2A program and ensure adequate supply of farm laborers as well worker protections.</p>
<p>(e)    W-2 visas will be for contract laborers; and W-3 visas will be for portable, at-will employment.</p>
<p>&nbsp;</p>
<p><strong>NONIMMIGRANT WORK VISA </strong></p>
<ol>
<li>Proposing an increase in annual cap on H-1B visas from 65,000 to 110,000 with gradual rise to 180,000 based on a High Skilled Jobs Demand Index</li>
<li>Protections for U.S. domestic workers by requiring employers to pay higher wages and undergo recruitment of U.S. workers.</li>
<li>Allocating more visas for those with degrees in science, technology, engineering, or mathematics (STEM), which could lead to Green Card status.</li>
<li>Providing a new W visa category for lower-skilled workers and their dependents.</li>
</ol>
<p>Initial W visa will be for 3 years, extension available if not unemployed for more than 60 consecutive days.</p>
<p>Eligible employers must be registered and comply with worker protections.</p>
<p>There will be annual caps of W visas for first four years, beginning April 1, 2015 (20,000 for first year; 35,000 second year; 55,000 third year; 75,000 fourth year).</p>
<p>There will be a newly established Bureau of Immigration and Labor Market Research that will determine annual cap of W visas, declare shortage occupations, influence recruitment methods.</p>
<p>&nbsp;</p>
<p><strong>EMPLOYMENT VERIFICATION </strong></p>
<ol>
<li>Mandatory employment verification system (E-Verify) will be required. All employers must comply within five-years of issuance of implementing regulations; time frame varies depending on number of employees.</li>
<li>Non-citizens must show biometric work authorization card at time of hiring and be photo-matched with system.</li>
<li>U.S. citizens will undergo photo-matching of passports or drivers licenses.</li>
<li>Social security numbers will be “locked” into E-Verify system.</li>
</ol>
<p>&nbsp;</p>
<p><strong>NATURALIZATION </strong></p>
<ol>
<li>English and civics requirements will not apply to: (a) those with mental or physical impairment ; or (b) 65 or older, been a Green Card holder for at least 5 years (new)</li>
<li>Civics requirement can be waived for anyone who’s at least 60 and has been an LPR for 10 years (new).</li>
<li>English not necessary if: (a) At least 50, and Green Card status for 20 years; (b) At least 55, Green Card status for 15 years; (c) At least 60, Green Card status for 10 years (new).</li>
</ol>

<p>On May 7, 2012, BALCA discusses <em>In the Matter of </em><em>MMB STUCCO, LLC,</em> a PERM case, where there is a “closely held corporation or partnership in which the alien has an ownership interest, or familial relationship”, the totality of the circumstances (as opposed to single factor) must be considered in determining whether or not a bona fide job opportunity exists.  BALCA stands for Board of Alien Labor Certification Appeals and is part of the U.S. Department of Labor (DOL). PERM is DOL labor certification program and stands for <em>Program Electronic Review Management.</em></p>
<p>The totality of the circumstances for consideration, among other factors, include whether the alien:</p>
<ol>
<li>Is in the position to control or influence hiring decisions regarding the job for which labor certification is sought;</li>
<li>Is related to the corporate directors, officers, or employees;</li>
<li>Was an incorporator or founder of the company;</li>
<li>Has an ownership interest in the company;</li>
<li>Is involved in the management of the company;</li>
<li>Is on the board of directors,</li>
<li>Is one of a small number of employees;</li>
<li>Has qualifications for the job that are identical to specialized or unusual job duties and requirements stated in the application; and</li>
<li>Is so inseparable from the sponsoring employer because of his or her pervasive presence and personal attributes that the employer would be unlikely to continue in operation without the alien.</li>
</ol>
<p><em>In The Matter of Stucco</em>, the alien was the brother of the owner of the sponsoring employer, but had no ownership interest in the company.  For reasons stated in the decision, BALCA ordered that the denial of labor certification be reversed and directed the DOL Certifying Officer to grant this PERM permanent labor/employment certification.</p>

<p>Processing time for employment-based lawful permanent residence (green card) preference category cases (EB cases) are tied to immigrant visa number availability.  Immigrant visa numbers can retrogress (take much longer than the government’s previously estimated processing time).  The wait time for an immigrant visa number for an employment-based case is determined by a case’s priority date, the employment-based preference category (EB category) and the foreign national beneficiary’s country of birth (not nationality).  A priority date is the date of filing a case (such as the date of filing a PERM or an I-140 Immigrant Petition).  The types of EB cases include extraordinary ability, outstanding professor and researcher, multinational executive and manager, exceptional ability, national interest waiver, PERM labor certification, and others.</p>
<p>On May 8, 2012, the U.S. Department of States issued the latest summary of immigrant visa number availability in its Visa Bulletin June 2012.   In June 2012, immigrant visa numbers are available for employment-based green card preference category 2 for foreign nationals of all country of birth other than India or China (no visa numbers available for China or India).   The cut-off priority dates for EB preference category 3 is August 8, 2005 (China), September 15, 2002 (India), May 22, 2006 (Philippines), and June 8, 2006 (Mexico and all other country of birth).</p>

<p>Choosing the correct and most suitable immigration classification and category when initiating and applying for green card status in and to the U.S. is extremely important.  Depending on the type and/or classification of the green card, the wait time to obtain green card status varies tremendously, and the difference can be several months, to several years or even decades.</p>
<p>Immigrating to the U.S. via sponsorships through certain skill sets or employment are effective ways to legally and permanently live and work in the U.S., or gain legal permanent residency status in the U.S.</p>
<p>The employment-based green card cases in the U.S. fall under several preference categories. Some of the categories include, but are not limited to, green card employment-based preference 1 category (“EB-1”), employment-based preference 2 category (“EB-2”), and employment-based preference 3 category (“EB-3”). Choosing the most effective employment-based green card preference category is important to the foreign nationals for many reasons. For foreign nationals who have any green card cases (whether or not based on employment) that have been pending for too long, right now will be a good time to review various employment-based green card options. The differences in the various EB categories include, but are not limited to:</p>
<p>1. Many employment-based green card cases require sponsorships by employers. Other employment-based green card cases do not require the sponsorships of any specific employers, and can be self-petitions or self-sponsorships by the foreign national themselves.</p>
<p>a) For example, an EB-3 green card case requires the sponsorship by an employer.</p>
<p>b) On the other hand, an EB-2 national interest waiver green card case that is based on the foreign national’s contribution to the industry does not require direct sponsorship by an employer.</p>
<p>c) An EB-1 extraordinary ability green card case is a self-petition immigration case, and does not require the sponsorship by an employer.  Certain EB-1 green card cases require the sponsorship by an employer.</p>
<p>2. The wait time for green card cases for the various employment-based preference categories or cases can vary widely, ranging from several weeks or several months, to almost 9 years, because their wait time are tied to the employment-based preference category and the foreign national beneficiary’s country of birth (not nationality).</p>
<p>a) For example, the wait time to receive a green card based on an EB-1 case is tremendously shorter (e.g. several months or weeks , or longer depending on each case) than an EB-3 case (many years) because immigrant visa numbers are often more readily available for an EB-1 than an EB-3 case.   Also, the wait time for an EB-2 national interest waiver case is tremendously shorter (e.g. several months or weeks, or longer depending on each case) for native from many countries (not all).</p>
<p>b) For example, under an EB-2 case based on PERM, it takes substantially longer for a foreign national who was born in India or China to receive his/her green card (several years) than a foreign national who was born in other countries.</p>
<p>c) However, if a foreign national who was born in India or China is eligible and is applying for an EB-1 green card case, the wait time will be tremendously shortened.</p>
<p>d) Other than a bona-fide/genuine/good-faith marriage to a U.S. citizen, having relatives to provide immigration sponsorships to foreign nationals are by no means good solutions.  Certain family-based green card sponsorships could take decades to come through.</p>

<p>3. Moreover, green card processing time at various government agencies changes from time to time, depending on diverse factors such as their immigration case load, the number of green card applicants in a given period, new law and/or policies.</p>
<p>a) The processing time for various employment-based green card categories can retrogress (e.g. taking much longer than the government’s previously estimated processing time).</p>
<p>b) For example, the processing time for many EB-3 green card cases retrogressed from a processing time of about 8.5 years in April 2009, to a sudden halt (no processing) for the month of May 2009 when immigrant visa numbers became unavailable for May 2009.  The U.S. Citizenship and Immigration Services (“USCIS”) cannot adjudicate green card I-485 adjustment of status cases without the available immigrant visa numbers.</p>

<p>4. Some foreign nationals are deterred and discouraged by the dampening economy from, or their dim view in securing U.S. employment, and/or immigration or green card sponsorships.</p>
<p>a) For foreign nationals who do not have or wish to secure immigration sponsorships by U.S. employers, being able to apply for employment-based green card by themselves without any specific employers (i.e. self petitions or self sponsorships) can make a huge difference in their lives.</p>
<p>For example, the differences of either falling into illegal immigration status in the U.S.; not coming or immigrating to the U.S. or having to leave the U.S. (most often, after years of being in the U.S. with established social circles and families here); or the privileges and opportunities to live anywhere in the U.S. with U.S. permanent residency status, and eventually, the opportunity to apply for U.S. citizenships.</p>
<p>In summary, choosing the most effective category of green card cases means the difference of waiting decades for your green card, to several months or weeks. Having a green card much sooner also means having the opportunities to choose to live and work anywhere in the U.S., and eventually, to apply to be a U.S. citizen.</p>

<p>Recently, there have been reports that original certified forms ETA 9089 for permanent labor certification PERM process were not received.  There was also an incident where the original certified form ETA 9089 was lost after being filed with the I-140 Immigrant Petition.  Lost of original certified forms ETA 9089 unnecessarily complicates and increases green card processing time for foreign nationals and their employers.  <em>For more information on the PERM process, please read the last paragraphs below</em>.</p>
<p>In a situation where the original certified form ETA 9089 is unavailable, the employer-sponsors may be unaware that their forms ETA 9089 have been certified, thereby missing the crucial filing periods for their I-140 Immigrant Petitions.  The applicable I-140 petition must be filed during the validity period stipulated on the certified form ETA 9089. The original certified form ETA 9089 is submitted with the I-140 petition to the U.S. Citizenship and Immigration Services (USCIS).  It is also possible that the original certified form ETA 9089 is lost during the filing process of the I-140 petition after being sent off by the employer-sponsor. </p>
<p>Due to recent reports on missing original certified forms ETA 9089, the following steps are encouraged:</p>
<ul>
<li>For PERM application filed electronically, please check the online case status to verify whether it has changed from “in process” to “certified.” A pdf copy of the certified ETA 9089 can also be downloaded from the <a href="http://www.plc.doleta.gov/">PERM website</a>.</li>
<li>For PERM application filed by mail, please check the status of the case by e-mailing the U.S. Department of Labor (DOL) Atlanta NPC (National Processing Center) if the case is pending at least 3 months beyond the current processing date.</li>
<li>Also check the <a href="http://icert.doleta.gov/index.cfm">iCERT portal’s</a> latest PERM processing time at <a href="http://icert.doleta.gov/">http://icert.doleta.gov/</a> . If the pending PERM case is more than 3 months beyond the date being processed, send an inquiry to the applicable DOL PERM center. </li>
<li>If original PERM approval was never received, one can submit the I-140 petition with a copy of the approval (or with other proof that it was certified, such as an e-mail from the Atlanta NPC), and ask USCIS to request a duplicate certification from DOL.   Also, if the certified ETA 9089 is lost during I-140 petition processing after filing, it may be best to ask U.S. Citizenship and Immigration Services (USCIS) to request a duplicate certification from DOL by including a copy of the approval; and other proof that it was certified, such as an e-mail from the DOL.</li>
</ul>
<p>Foreign nationals may apply for green card to live and work in the United States via several methods.  The common methods of green card applications are green card lottery, employer sponsorship such as through PERM, self-petition green cards such as extraordinary ability or certain national interest waiver category, etc. </p>
<p>PERM is a process of permanent labor certification by the U.S. Department of Labor (DOL). PERM filing with the DOL is submitted via form ETA 9089.  Some green card sponsorships by employers require the PERM process and some do not.  PERM stands for Program Electronic Review Management System.  PERM is a process whereby the U.S. Department of Labor determines that:</p>
<p>a) The employer-sponsor has adequately tested the U.S. labor market to ascertain that there are no qualified, willing, able and available U.S. workers for the green card position;</p>
<p>b) The job requirements of the employer-sponsor are not unduly restrictive;</p>
<p>c) The offered green card salary meets the DOL prevailing wage criteria;</p>
<p>d) The employment of the foreign national will not adversely affect the wages and conditions of U.S. workers who are similarly employed; and</p>
<p>e) The foreign national meet the job requirements for the green card position in compliance with the criteria promulgated by immigration law.</p>
<p>Once the U.S. Department of Labor approves the PERM application by certifying the form ETA 9089, the employer sponsor may then submit the I-140 Immigrant Petition during the validity of the certified PERM form ETA 9089.  Depending on the criteria, the foreign national may also submit his/her I-485 Application to Adjust to Permanent Resident Status with the I-140 petition.  During the I-485 stage, the foreign national can also file for the I-765, Application for Employment Authorization Document (EAD card); and I-131, Advance Parole Document (an international travel authorization).</p>

<p>This additional fee requirement applies to new petitions and petitions to change employer filed by petitioners or employers that employ 50 or more employees in the United States, with more than 50 percent of its employees in the United States in H-1B or L (including L-1A, L-1B and L-2) nonimmigrant status.</p>
<p>H-1B is a temporary work visa for foreign nationals to work in occupations requiring at least the relevant Bachelor’s degrees, or equivalent.</p>
<p>L-1 is a temporary work visa for a U.S. company to transfer certain foreign national employees from one of its affiliated foreign offices to one of its existing or newly established offices in the United States. L-1 temporary work visa applies to foreign national employees who will be transferred to the U.S. as an executive or manager, or a professional employee with specialized knowledge relating to the organization’s interests from one of its affiliated foreign offices.</p>

As a result, the U.S. consulates across China have also seen a corresponding rise in visa applicants and wait times for visa appointments.  In 2009, 66% of the visas issued by the U.S. consulates in China were for business and tourism to the United States.  </p>
<p>In their efforts to meet the extraordinary growth in visa demands, the U.S. consulates in China are actively expanding their staffing and enhancing their technological systems, as well as working over the holidays.  For example, over the next few weeks, through the “Super Saturday Visa Program”, the U.S. Embassy in Beijing, and four U.S. consulates in China, will be opening on Saturdays for the increased Chinese applicants seeking visas to travel to the United States.</p>
<p>IIt is extremely important for foreign nationals traveling to or for those already in the U.S. to adhere to and comply with the complex U.S. immigration law to avoid serious immigration complications.  This applies to U.S. lawful permanent residents (LPR) as well.  Some of the general matters to consider include, but are not limited to, not overstaying the period of authorized stay (such as the expiration date as endorsed on the I-94 departure/arrival record for non-LPR); not accepting employment in the U.S. without first seeking proper immigration authorization; not perpetrating, committing or attempting to commit visa or immigration fraud.</p>
